Scope of request:
In the Applicant’s email of 15 July 2026 they note: The CEFC Quarterly Investment Report dated 31 December 2025 records the following transaction:
“31 October 2025 – Equity investment in a carbon plantation forestry project – $69 million – Tasmania.”

[They] seek access to final documents held by the CEFC relating to that specific transaction, limited to documents or extracts recording:

1. the name of the project, counterparty, fund, trust, investment vehicle, special-purpose entity, asset manager or related entity;
2. whether the investment relates directly or indirectly, including through a fund, trust, portfolio or related entity, to:
   1. Rushy Lagoon;
   2. Tasmania Natural Asset Trust; 
   3. Tasmanian Natural Asset Trust;
   4. Gresham House;
   5. Aviva Investors;
   6. the purchaser or developer of Rushy Lagoon; or
   7. any related project entity;
3. the total amount contractually committed by the CEFC; 
4. the amount paid, drawn, invested or deployed to date;
5. any amount remaining undrawn, conditional or available;
6. the date of investment approval and the date of contractual commitment or financial close;
7. the form and extent of the CEFC’s support, including whether it is equity, debt, guarantee, co-investment, concessional finance or another form of financial exposure;
8. and any condition precedent, material condition or dependency relating to:
   1. Foreign Investment Review Board or Treasurer approval;
   2. completion of the acquisition of Rushy Lagoon;
   3. acquisition of any other Tasmanian agricultural property;
   4. plantation establishment;
   5. land-use conversion;
   6. Commonwealth plantation grant funding;
   7. registration under the Australian Carbon Credit Unit Scheme;
   8. generation or sale of ACCUs; or
   9. minimum plantation area, carbon return or project milestone. 

Documents within scope include the final Board, Investment Committee or delegated approval minute or resolution, final investment approval paper, final transaction summary, executed commitment document, term sheet, financial-close record, or equivalent document.

This request is confined to the specific $69 million Tasmanian transaction recorded on 31 October 2025 and any final documents recording its implementation or status up to the date of this request.

To reduce the processing burden, I exclude:

• duplicate documents;
• drafts where a final version exists;
• personal contact details and signatures;
• legal advice;
• detailed valuation and financial models;
• bank account, taxation or security information;
• detailed technical due diligence annexures;
• proprietary methodologies; and
• portions of agreements unrelated to the matters identified above.

If the final approval paper or transaction summary contains the information sought, I am content for the CEFC to process that document together with the most recent document recording the investment’s drawdown or implementation status, rather than processing duplicative documents.

Where a document contains exempt or commercially sensitive material, I request access to an edited copy under section 22 of the FOI Act.

At a minimum, I seek disclosure of:

• the identity of the project, counterparties and investment vehicle;
• whether the investment relates directly or indirectly to Rushy Lagoon;
• the total amount and form of CEFC support;
• the amount deployed and remaining;
• the date and current status of the commitment; and
• the existence and general nature of any relevant conditions or dependencies.
